A man has been fined $20,000 for selling unlicensed drugs after it emerged he was buying unlicensed Viagra for a drug he didn’t know was the same as a prescription medicine.
Neil Fosfowss, 44, pleaded guilty to three counts of illegally dispensing unlicensed prescription drugs.
Judge John Smith found him guilty before a jury of four counts of conspiring to traffic in unlicensed drugs and one count of importing unlicensed drugs.
“It was the government’s burden to prove the three counts. I am satisfied that the defendant was found guilty on all counts,” said Smith.
The government did not comment on the fine but said it was “fairly fair” to make the fine amount the maximum penalty under the Food, Drug and Cosmetic Act (FDCA).
Fosfowss said he was given a three-month suspended sentence and that his licence was restricted to use under the terms of a licence agreement.
The licence agreement stipulates that Fosfowss and a co-conspirator can sell the drugs for personal use in the “personal use” area. They can also sell unlicensed drugs to other people in the same area for off-licence.
Fosfowss was sentenced to four months’ probation with six months’ imprisonment. The judge also ordered that Fosfowss’ licence be revoked, and ordered him to pay the fine.
